Modification of Court Orders in TX

Turn to Us for the Outcome You Need

While your divorce may have been finalized months, or even years, ago, there is a good chance the dynamics of your family have changed since then. As a result, you may need to have your court orders modified, but this can be a daunting process. Slate & Associates, Attorneys at Law can help you navigate the complex court system while protecting your rights every step of the way.

Same-sex couples can still face unique legal challenges despite the fact that marriage and divorce is now legalized in all 50 states. You need a Deer Park divorce attorney who will do whatever it takes to obtain a fair outcome – we can advocate on your behalf. Whether you are hoping to modify a child support or alimony order, award-winning legal representation can be found at our firm.

What is Required to Modify a Court Order?

The process of modifying a court order for same-sex couples is similar to the process that heterosexual couples must follow. Essentially, the court is looking for a valid reason to alter the orders and one party’s individual preferences typically does not constitute a valid reason.

The court must see proof of the following before modifying an order:

  • A material and substantial change in circumstances
  • That the change would be in the child’s best interests (child custody orders only)

Proving one or both of these things can be difficult, but we have experience with successfully showing the court that an order modification is necessary. The two most common examples of a change in circumstances are the loss of a job or a serious health issue. There are, however, other events that can warrant a modification.
