What is Required to Modify a Court Order?

The process of modifying a court order for same-sex couples is similar to the process that heterosexual couples must follow. Essentially, the court is looking for a valid reason to alter the orders and one party’s individual preferences typically does not constitute a valid reason.

The court must see proof of the following before modifying an order:

  • A material and substantial change in circumstances
  • That the change would be in the child’s best interests (child custody orders only)
